Habersham County Georgia Chief Magistrate Judge. James N. Butterworth faces Pre-Warrant Hearing
This Judge had one main duty as Magistrate Judge of Habersham County and that was to issue a warrant requested by Citizen Beth Zimmerman for the charge of misdemeanor stalking, if there was probable cause, or dismiss for lack of probable cause. This Judge instead and against UNIFORM MAGISTRATE COURT Rule # 25.3(E) (The judge conducting a warrant application hearing is without jurisdiction to make final disposition of the case or cases at the hearing by imposing any fine or punishment.) and against my rights and my mother’s rights under the US Continuation and Georgia Continuation took me and my mother into custody and held us until I gave in to his demand under duress and agreed to be banished, and sign his order consenting to being banished from the State of Georgia as a condition of a continuance on a pre-warrant probable cause hearing. Which I was not charged with any crime.
I have tried for almost a year now to find real unbiased justice in Habersham County. I have sought help from the Sheriff’s Office many times. I have sought help from the Habersham County Commissioners only to find they turn a blind eye to the Good ol' boy small town justice system now in Habersham County. So I now take the only step left to me as a Georgia Citizen when the system fails to police its own. This Judge violated the laws of Georgia and the Constitutions he swore to uphold when he deprived me of my rights and banished me from my home without legal just cause and authority to do so.
I have only wanted a fair investigation into the claims against me. I do not understand a County that will not spend a few hundred dollars to investigate a crime but will spend thousands and make its self negligent and liable for damages to cover up a crime. I challenge the Sheriff’s Office, DA and the Habersham County Commissioners to do their Job and the right thing and have this matter investigated and stop the bias small town justice system now in Habersham County.
Please help me get this story out so justice can be done and I can get a fair day in court against this Judge for breaking the laws and Constitutions he swore to uphold.
