    (After March 23, Jiang Yi Hua, the premier of Executive Yuan, and Wang Zhuojun, the director-general, claimed that every action the police took is legitimate. Such announcement has provoked wide discussion.)

    About the Fallacy the Premier of Executive Yuan and the Director-General Claimed

    因為多數的朋友都沒有站在拿盾牌的那一邊的經驗,所以我出來解釋一下。我曾經在警總岩灣職訓總隊服役,經歷過與二清專案的兄弟們兩年的生活,帶過鎮暴班,也指揮過幾次鎮暴,最大規模有四五百人的鎮暴部隊隊伍 (警總本部中隊和憲兵的混合臨時編制),我們對付的是真的暴民,是管訓的流氓。我來分享我的經驗。保警和一般的警察杯杯不同,大家別因行政院事件就不爽警察杯杯,還是該尊敬辛苦的警察杯杯。上面的也知道多數的一般分局的警察杯杯是不會去動手的,所以才叫保警進來。我因為工作的身份,沒打算紅,不想給公司帶來麻煩,也不想寫不自殺宣言,所以大家看看就好,要轉就自己複製發佈,當無名氏寫的,無版權限制。
    I’d like to explain (about the police’s expelling action) here, since most people have no experience of holding a shield and standing behind it. I served the Garrison Command Yanwan Skill Training Institute. I’ve experienced the Second Sweep Project (to eliminate gangs) and lived 2 year with my fellows, and stayed as an antiriot police and even directed few antiriot actions. The largest scale of the antiriot team was up to 400-500 members (temporarily organized with military police). We were against real mob and rogue. Let me share my experience/knowledge. Special police is different from general police. Please don’t be upset with general police just because of the Executive Yuan Incident (what happened on March 23); we should still respect those hardworking police. Those superiors must have known that most general police will not attack; that’s why they demanded special police to the scene. Owing to my identity and individual safety, plus I have no intention to be famous, I will not tell my name. You can treat me as anonymous and share this article.


    第一,保警除非是訓練有誤,不然就是故意殺人。我一進岩灣本中,老鳥就一直提醒,鎮暴時,千萬只能打身體,打頭是會打死人的,在混亂的情況中,人一動,就會瞄不準,打身體都有可能打到頭了,何況故意?這次行政院事件中,有保警對無抵抗的民眾頭部瞄準揮棍,這有涉嫌過失傷害的嫌疑,我個人認為這跟涉嫌殺人未遂無異,即便是執行公務,亦無法免除涉嫌保警的犯罪事實。如果保警是因上級長官要求,而有此行為,亦不得免責。這些是我服役時的訓練,老鳥再三交待,要保護自己,別弄到後來,管人的變成被關的。我很難相信保警會不知道。
    First, the special police had intention to kill; unless they’re mistakenly trained. When I first joined the Yanwan, my senior kept reminding me that when in the riot, we can only hit the body; hitting heads could kill. When in a riot, it’s hard to aim since people are moving around; though we aim to hit bodies, we could still accidentally hit heads, not to mention if one intends to hit heads. In this Executive Yuan Incident, some special police aimed to hit defenseless people’s heads with batons. Such action should have involved Attempted murder. Though they were executing official duties, though/and such action were (possibly) demanded by their superiors, the fact that they had committed a crime can still not be absolved. This is what I had learned during my training. I was repeatedly told to protect myself, not to send myself into jail. It’s hard for me to believe that the special police have no knowledge about this.

    第二,針對無抵抗的民眾,鎮暴部隊唯一能做的就是把民眾搬離現場,不得動手。要是鎮暴部隊不爽,可以把民眾上手銬再搬離,然後不小心鬆手,民眾摔落地面,這都還合法。即便民眾之前有攻擊鎮暴部隊的行為,只要民眾趴在地上不動,蹲下雙手抱頭,坐下雙手舉高,對鎮暴部隊無立即的危險,就不許再動手攻擊這個民眾,即便之前他曾經攻擊鎮暴部隊,鎮暴部隊不該是暴民。
    Second, the only thing the antiriot team can do to defenseless people is to carry them out of the scene; the antiriot police can never attack them. If the antiriot police were upset, they can handcuff people and move them out, and accidentally loose their hands to dump people on the ground; this is so far legal. Even if someone has attacked the antiriot police, as long as he/she lies still on the ground, (or) crouches down and holds his/her head with hands, (or) sits down and raises their hands up, the antiriot police cannot attack people since they’re no longer in danger. The antiriot police shouldn’t be mob itself.

    第三,人是沒有理性的,保警亦是如此,我見過人的獸性能多可怕。人殺到或打到眼紅時,保警就變成暴警了。一個現場指揮官的責任,除了清除現場外,就是把打到眼紅的鎮暴部隊成員給隔離開來,免得打死人,重傷民眾。我認為當晚,有部分的節制,但是不夠,上述的第一點,也許與指揮官的全面觀察能力有關。我們以前鎮暴打的對象是管訓流氓,我指揮的幾次都沒有人被打破頭。我認為這次沒有學生死亡,是警察幸運。
    Third, human are of no rationality, so are special police. I’ve seen how horrible human beastliness can be. When one attacks too violently to draw back to rationality, even antiriot police can be mob. As a commander at the scene, his/her job, besides to clean the scene, is to separate those “mad police”, so as to prevent them from killing/damaging people. In my opinion, there was restraining in that night; however, it was not enough. Based on my first point above, I think it might have something do to with the commander’s observing ability. Dated back to the time when I was in the antiriot team against real rogue/gangster, in the times I directed, no one was hit in the head. I think the police are quite lucky since there is no death of students in this case.

    第四,用水砲車是極不負責任的。清除現場,除了水砲車,下一步就是開著警備車的大巴士,往群眾開過去,佔領空間。其實這兩招都是殺傷力極大的,不到萬一不該使用。針對武力攻擊鎮暴部隊的暴民,也要謹慎使用。因為在這兩招之後,就只剩橡膠子彈和實彈了的最終武器了。
    規範是,如果使用催淚瓦斯,搬離受催淚瓦斯影響、應無抵抗能力的民眾,都無法驅逐民眾,才可以動手打暴民,再無法控制,才用水砲。而且保警不該使用水砲打靜坐的民眾,水砲是用來打要攻擊鎮暴部隊的暴民,例如,如果學生對保警丟汽油彈,那才能用水砲。
    Forth, using water jet is extremely irresponsible. To clean the scene, besides using water jet, the next step is to drive prowl buses into the crowd to occupy space. In fact, these two tricks are really destructive. They should never be used until there’s no other way. Even when facing violent mob, the police should be cautious using such tricks; because after these, it will be rubber bullet and real bullet (the ultimate).
    The standard is that, after using tear gas, moving out defenseless people, if there are still people who can’t be driven away, the police can hit the mob; after all these, and the scene is still not under control, then the water jet can be used.

    第五,指揮的混亂。大家沒有發現警察當晚跳過了催淚瓦斯這一步,就動手打人?到今天警察還是沒有解釋,也沒有人去質疑警察。催淚瓦斯是要讓人失能的,這必要時得用,保護鎮暴部隊,也保護躁動的民眾。我猜他們是怕輿論攻擊,警察無必要而使用催淚瓦斯,一開始就決定不用。當上級給了更大的壓力要清除現場,而保警無法執行,於是就跳過了這個重要的步驟,或是現場指揮官就忘了,因為他腦子裏可能還想著不能用催淚瓦斯。然後棍子就飛了,水砲就開了。光是這點,警察就有業務過失的嫌疑,現場指揮官得為這個錯誤負責任。
    Fifth, chaotic directing. Do you find that the police skipped the tear gas and jumped to attack people? Until today, there is still no explanation from the police, and there is no one who questions that. Tear gas means to paralyze people; it is a way to protect both the antiriot police and the people. My guess is that they were afraid that the public voice would turn against them, so they had decided not to use it in the very beginning. When the pressure from the superior grows, and the special police is still unable to clean the scene, the commander can think of nothing but that they cannot use tear gas (or they simply forgot the standard). Consequently, their batons acted, the water jetted. Just based this, the police might involve duty negligence. The commander at the scene should take responsibility for this mistake.

    Feel free to deduce. I have to intention to speak for any party. As an ex-antiriot police, I think they are shameful for their uniform.
