    Derek is currently stuck in Colorado, His wife owns their house in NYS they have a 3 month old baby together and 3 of Derek’s step children. Derek has done all his time in prison yet is on “Mandatory” Parole in Colorado. For those not familiar with Mandatory Parole, it means anyone with a felony will serve their entire prison sentence plus parole, If that don’t make sense to you it’s because only 3 US states practice this, Colorado being one of them. Normally when a person does ALL their time there is no parole, they are free.

     

    Being on Parole in Colorado Derek put a transfer request in to the interstate compact to transfer his parole to NYS.

    On May 11, 2009 Derek and his wife were informed that Derek can not parole home with his wife and kids. NYS Parole in Buffalo denied the request based on two issues;

    1) They say Tina (Derek’s wife) wasn’t cooperative when Derek absconded and went home last year ..

    * This isn’t entirely true. Yes he was with his wife but she did call Colorado Parole and tell them he would be leaving 3 days before he left, they ignored the call. It took Colorado 3 months to go get Derek in NYS. When the police showed up to get him, Tina willingly let them in the house to retake Derek.

    The reason Derek absconded was because a gang put a hit on Derek’s life. Derek was attacked and left on the streets of Denver (2 minutes from the Denver shelter) with injuries to his head from the first attempt on his life, when he tried to relocate in a Parole approve hotel a few blocks down the road, his parole officer instructed him to return to the Denver shelter, Derek attempted to explain the situation to her, she wouldn’t listen and wouldn’t help, she told him to get to the shelter or go to jail. Derek went back to the shelter, days later ran in to the gang members at a store, Derek ran, went to the bus station and left Colorado in fear that no one was willing to help him in Colorado.

     

    Derek never got to pled his case on why he absconded, He and his wife requested an attorney several times after Derek‘s arrest and extradition, they never got one. The parole officer who ignored him (Stoneking) never even got a slap on the wrist. She denied her actions, no investigations were done.

     

    2) Derek has one domestic case in Colorado from 1998. Buffalo Parole office said they would not allow Derek to reside with his wife and kids because of that. BUT it had nothing to do with them, they didn’t even know Derek then, AND the same Buffalo parole office allowed another parolee (Melvin Stephenson - the husband of Tina‘s former friend) to parole to Tina’s house March 2008. Mel has several previous and newer domestic cases.

     



    Those were the two reasons the Buffalo Parole office gave when they denied this family to be together, Tina was in the exact same situation when they allowed one man to live with her and her children, but in the same situation her husband can not live with them.

     

    Tina talked to a parole officer (Mr. M.Fr) in the Buffalo office who assured her it wouldn’t be hard to get Derek paroled home to her. The parole officer in question asked Tina not to reveal his name but assured her he would have been Derek’s parole officer, he knew Derek’s case and accepted it. Then During the retaken of Derek NYS police showed up with a warrant that claimed Derek was wanted for absconding and another charge that was dismissed in 1998. The police stood at the end of the driveway of Tina’s house yelling in her face about this change all while the neighbors surrounded them. News traveled fast, Tina lost a lot that day, she lost her side job, her daughter suffers from discrimination in School, they all suffer from mental anguish, they can no longer practice their religion in Church, She can not get any help from anyone, and her neighbors treat them poorly… All due to the officer yelling out for all to hear about a case that was dismissed (a very serious case of defamation). The arresting officer later called Tina to apologize because after getting Derek to the station they discovered the only thing that should have been on that warrant was “absconding”, Derek went to court in Littlevally, NY where the judge ruled he was guilty of nothing but absconding.

     

    Tina was instructed by several people, including the supreme court to sue Colorado for issuing a warrant with false information and NYS parole for not verifying the information on the warrant before contacting the police, and for destroying their lives over a warrant that never should have been accepted as it was.

    Tina mentioned this to the Parole officer who made the statement he would help her, this parole officer then called Tina to tell her they would not allow Derek to parole to NYS.

     



    It is clear that NYS was willing to accept Derek’s transfer to be with his family until they screwed up the retaken of Derek, at which time they found reasons not to accept Derek’s transfer. Tina contacted the NYS Interstate Compact to question why the rules specify the transfer is mandatory if NYS parole is allowed to disregard that rule, she also asked them to investigate based on the information provided. No investigation was done and they simply replied “the denial was according to the impacts rules” … Tina contacted other Government officials whom instructed her to contact NYS Parole in Albany, they responded by saying “the denial was with in guidelines” and also no investigation was done.

     

    This family is struggling with being bullied by law enforcement in both NY and Colorado. They have been the victims of both states mishaps and cover up’s.

     

    In all of this the family isn’t trying to recover lost money or even an apology, all they want is to be together as a family in their NYS home and to raise their children together.
