    YOUR RIGHTS - That Jamie Sacraficed for! A different kind of soldier!

     

    This is a follow up to the first post that I wrote earlier on Jamie Jones.

    Sadly Jamie is still fighting this case but has accomplished some key steps! It is undescribable that she has to go through this in the first place, du to our JUSTICE DEPARTMENTS call.

    When Jamie presented her case to the DOJ, they claimed that according to Coalition Provisional Authority Order 17; any attacks or criminal actions that happen in Iraq by contractors is up to the Iraqii governtment to resolve.

    Order 17 states: Contractors shall not be subject to Iraqi laws or regulations in matters relating to the terms and conditions of their Contracts, including licensing and registering employees, businesses and corporations; provided, however, that Contractors shall comply with such applicable licensing and registration laws and regulations if engaging in business or transactions in Iraq other than Contracts. Notwithstanding any provisions in this Order, Private Security Companies and their employees operating in Iraq must comply with all CPA Orders, Regulations, Memoranda, and any implementing instructions or regulations governing the existence and activities of Private Security Companies in Iraq, including registration and licensing of weapons and firearms. The PSCAI, the association of security companies based in Iraq, advises its members on these matters. It is headed up by a former Marine, Lawrence Peter.

    I could have translated this, but who is to say that my interpretation of this law would suit everyone’s perception, there for I posted the law.

    The United States Department of Justice CABINET Department in the United States govt. designed to enforce the law and defend the interests of the United States according to the law and TO ENSURE fair and impartial administration of justice for all Americans. The DOJ is administered by the United States Attorney General.

    What does Cabinet mean: is composed of the most senior appointed officers of the executive branch of the fed government of the US; Cabinet officers are nominated by the President and then presented to the US Senate for confirmation/ rejection by a voting requirement of more than 50% of all ballots cast.

    So when the DOJ was subpoenaed to appear before Congress and never showed up……

    Sadly, sexual harassment, up to and including sexual assault, is a reality in today’s workplace.” One Judge in the DOJ said. He then sent the case to binding arbitration as requested by Halliburton and its former subsidiary, KBR, snuffing out the civil case of their employee, a mother of five who had filed a lawsuit alleging sexual harassment and assault by co-workers while on the job in Iraq.

    On another note, many conservative bloggers, have been posting bashing news against Jamie, and claiming she is “belittling war efforts” by coming out… they have also tried to state that she is fake because she is speaking out instead of “hiding” her attack. John Smith, Ted Frank, Rush Limbaugh and Bill Owens are some of the conservatives who have spoken out against Jamie’s case.

    Does this sound familiar???

    Here is a direct quote from John Smith’s blog site, I quoted because no one would believe this level of arrogance I start off with the statement they used from the doctor as a rational reason to dispute her rape existing, and then close it with asking her to shut up:

    “The more you learn about her story the more difficult it is to believe. Although there was a rape kit that confirmed she was sexually assaulted, it was lost and found again and the doctor who performed it doesn't remember doing it. "I have no idea which rape victim you are," the doctor told Jones, "because so many young contractor girls were raped after drinking with the guys…. I performed so many rape kits in the six months that I was stationed there that there would be no way to recall whom yours was." It seems to me the testimony of the doctor alone casts doubt on her allegations and exculpates Halliburton/KBT. Case closed.

    Even if her story is true, you have to wonder why Jones doesn't just keep her mouth shut like all the other women the doctor says have been raped in Iraq. Doesn't she realize that such an incendiary charge just gives aid and comfort to the enemy? How can we convince Iraqi women like the young women of Basra -- where 40 of them have been murdered for dressing contrary to Islamic law -- that replacing Saddam Hussein's secular government with an Islamic government actually makes them more free, if American women are not willing to make a few sacrifices to get this message across?

    Jamie today:

    Jones, endorsed a proposal by Rep. Hank Johnson, D-Ga., called the Arbitration Fairness Act of 2009, which would prevent pre-dispute mandatory consumer, employment and franchise arbitration agreements that take away the right to take a case to court. Supporters claim that private arbitration gives unfair advantage to large companies.

    Jones' case has not yet come to trial. Halliburton attorneys said last year that Jones' employment contract she signed before taking her job states that claims by employees have to be settled in private arbitration.

    Last year, a Texas judge issued an order allowing her to present her case in court.

    "Unfortunately, my case is not an isolated incident," she said  "With the misuse of arbitration, we have made corporate entities in this country above the law."

    Since returning to the United States, Jones has made it her mission to fight for the protection of citizens who work overseas.

    In 2007, she established the Jamie Leigh Foundation, a nonprofit advocacy organization that gives advice to U.S. citizens and legal residents who become crime victims working abroad for government contractors and subcontractors. Jones says that if she "never gets justice," she at least will have been "a voice for others" who have been victimized by rape and arbitration laws.

    The sad part about this report is that many people that don’t get it. They do not understand why someone keeps up the fight, they do not understand what motivates them beyond self gratitude or benefits, they do not get it.

    What motivates me and Jamie and other women, is said best “I fight not for myself, but for your mother, your sister, your daughters, for they are mine, as well, that is a our job, whether enlisted or not.” Said by Aneko Snow.
