Domestic Violence Victim Requests Congressional Investigation and Files a Charge of Discrimination Against Law Enforcement Agencies

Robin West has asked Steven LaTourette (D-Ohio) to ask for a Congressional investigation into why Sangamon County, Illinois and Ashtabula County, Ohio prosecutors have not yet charged Dean L. West of Springfield with the crimes Ms. West is alleging he committed against her.   She is alleging attempted murder, both in March of 2008 and in Fall of 2009 when he tricked her into moving to Tucson, Arizona.   She is also alleging fraud and has filed a complaint for Annulment in Geauga County, Ohio on the basis of fraud and has been granted a five year Civil Order of Protection.

Ms. West filed her discrimination charge via fax on November 23, 2009 and via e-mail on December 15, 2009 and is waiting to hear from the US Department of Justice on the matter. She is alleging that several law enforcement agencies discriminated against her  "...because I have PTSD and am on SSI, disregarding my value as a human being and writing me off, thus, allowing me to be victimized and harmed repeatedly by Dean Lynn West, therefore, denying my rights as a crime victim under federal laws and ignoring state criminal codes and statutes of limitations and thereby denying my basic human rights under the Constitution."

Among the nine agencies named in her complaint are: the Springfield Police Department, the Sangamon County State's Attorney's Office, the Illinois Attorney General's Office, the Tucson Fire Departmen and the Lyndhurst Police Department.

Other people, such as Tammi Carney, her former fellow student from Brush High School in Lyndhurst, Ohio and Janet Makinen of Dade City, Florida, have been informing others through the use of the internet and telephone, encouraging them to show support for Ms. West's effort to see charges filed against Dean L. West.

Sangamon County Assistant State's Attorney Roma Larson  Accused of Lying

"Roma Larson, DV Darling Prosecutor for the Sangamon County State's  Attorney, lied in a letter excusing herself from prosecuting Dean L. West,"  Robin D. West alleges.  Upon learning that Roma Larson had  applied to be an associate judge in the 7th Judicial Circuit  Court this year, Ms. West asked "How can a woman who lies to her  bosses, to the Sojourn Center, and to a victim in a letter  of excuse even think she has the qualifications needed to be a  judge?"   Ms. West has released the letter and her responses to  that letter in a faxes she sent to the Sangamon County State's Attorney  yesterday in her continued effort to make Dean Lynn West accountable for a  number of crimes she alleges he committed against her.  Ms. West,  who suffers from PTSD and is disabled, claims that the inaction of the State's  Attorney in Springfield impacted her illness and made her vulnerable  to Mr. West allegedly defrauding her of her, "...entire life."

In a phone conversation with Sgt. Anderson of the Springfield Police  Department this week, Ms. West was advised that their unwillingness  to investigate information she has ready for them at this  time lies with the State's Attorney's office and not them.  When Ms.  West asked Lt. Peters of Springfield Police Internal Affairs if there  was direction given to the Police by the State's Attorney's Office not to  help her no matter what crime she alleges Dean West committed, Lt.  Peters said that he was not personally aware of any.  Ms. West is  expressing concern over what she sees as an unwillingness to criticize Roma  Larson because she is seen as a helper of victims. "I was informed by a reliable  source at Sojourn Center that Ms. Larson 'stinks' in court.  I have seen  this before in Cleveland, at Templum House support groups, where woman after  woman complained about how they had been treated by the Legal Aid  DV attorney at that time, while that attorney used her position to rise in  political stature.  When I asked the head of Legal Advocacy then why they  didn't do something about it, she replied that they were stuck with her and that  their presence was not yet established in the civil courts.  Local shelters  are generally autonomous entities, setting their own agendas and  picking their own battles.  Unfortunately, in some communities, funding of  shelters has been built around maintaining their continued presence in  courts and they can become tools of lawyers and elected court  officials, to the detriment of the individual victim.  I have seen and  experienced legal advocates basically rubber stamping actual errors made by  attorneys and judges.  One thing battered women desperately need in  America is sound legal advice, unfiltered and not garnished by any personal  slant or political motivation."  Ms. West states she has had  personal experiences with DV agencies in 5 Ohio  counties.

Ms. West was instructed by Sgt. Anderson to give any new evidence she has  directly to the State's Attorney's Office in Springfield, so she sent a number  wav. recordings of Mr. West, she says help prove what she  alleges about him, to Assistant State's Attorney John Milhiser, to whom she  has appealed for assistance in reversing the decision of Roma Larson not to  prosecute Mr. West.  In defense of her not giving this information to the  police sooner, Ms. West states that she has experienced involuntary PTSD  reactions to reading the documents and listening to the tapes, delaying  her attempts to organize them.  Ohio allows one party consent for  recording of phone calls and Ms. West hopes some of them can be admitted  into evidence in court under the doctrine of constructive  acquiescence.   Mr. West claimed in a Sangamon County Court proceeding  recently that Ms. West initiated unwanted contact with him from March  through July.  Ms. West alleges that phone recordings indicating timing and  phone records will prove that Mr. West committed perjury to obtain a Plenary  Order of Protection against her in August "to assist him in committing  more fraud and in order to further abuse me by harassing me and  attempting to restrain a crime victim from my first amendment rights,  amazing coming from a self-proclaimed anarchist."   Ms. West has filed  a Petition for Reconsideration and a Petition for Rule to Show Cause for  Contempt for alleged perjury on the part of Mr. West.  She hopes the court  will take into consideration an involuntary PTSD reaction to stress which  rendered her unable to speak at the hearing, leading to a ruling she feels  was actually given by default.

Domestic Violence: Harming your wife seems a-ok in Springfield, Illinois

Two video slide shows of some of the pictures taken of injuries allegedly perpetrated by Dean Lynn West on Robin D West are on YouTube at the following link: http://www.youtube.com/abittadissandat.  The Illinois statute of limitations on a misdemeanor charge for the March 17, 2008 incident runs out tomorrow.  The Illinois felony statute of limitations is twice that.  Ms. West asserts that she has provided information to the police and the State's Attorney which will refute any lies Mr. West tells about the incident.  Robin D. West states that Dean West is a con artist who at one point emptied her bank account to help get the City of Springfield off his back for housing code violations and then tricked her into giving up everything and moving to Tucson, Arizona.  Ms. West states that Dean West lies constantly but that many of his lies are provable, beyond a reasonable doubt, and that he recently committed perjury to obtain a civil Order of Protection, in an attempt to silence her, just one of a string of people he has victimized over his lifetime.  Ms. West asserts that the simple act of obtaining Mr. West's cell phone records from the past two years would help clear away any fog and/or smokescreen Mr. West creates but to her knowledge this was never done, even though she requested it be done since the March 2008 beating. Dean Lynn West is currently on probation for Resisting a Peace Officer during a week in which he was arrested twice in 2008.  Robin D. West states that she has received a letter from the DV Assistant State's Attorney which contained several inaccuracies, not addressed here, but, a big issue was made over the fact that she returned to Ohio in March of 2008 instead of staying at the Sojourn Center from where she could "...pursue further steps to ensure your safety and hold the perpetrator of your injuries responsible for his actions, but you insisted on returning to Ohio, leaving the safety Sojourn could provide and the accountability Sangamon County law enforcement could seek..."  Ms. West told the police, the hospital staff at St. Johns, the victim's advocates from Sojourn and Prairie CASA that she had a job with no sick pay and no job security, a home, and animals that needed fed in Ohio and that she had never moved to Illinois.  Ms. West waited every morning at work for the promised call from the DV prosecutor so that Mr. West would not see that call on the cell phone plan they still shared at that time.   When she finally heard from Roma Larson at the end of the week of the March 17th, 2008 beating, Ms. Larson stated that she would file a misdemeanor charge right away.   Ms West, who had to take Morphine to work with fractured ribs and who at one point had to pick a 98-year-old woman up off the floor at Chardon Assisted Living in pain, wondered aloud to Ms. Larson as to whether the severity/brutality and duration of the beating was cause for a felony charge.  Ms. West feels now that was a huge mistake.  An inside and reliable source, a legal advocate at Sojourn Center, stated to Ms. West that Roma Larson "stinks" in court.   Ms. West wishes that Ms. Larson would have advised her at that time not to even ask for a felony charge.  Later on, Mr. West told Ms. West that one of the main reasons he emptied her bank account at Springfield ATM's in August and September, 2008, supposedly for foundation expenses with the promise of remarriage and an invitation to move there to a mortgage and rent free, judgment proof home, and his subsequently tricking her into moving to Tucson, was that she had asked for a felony charge after the March beating/attempted murder/sexual assault.  Ms. West has decided that she is not paying anymore for the lies of others, no matter who they are, even if they happen to be an Assistant State's Attorney.
