    Recorded Loan Modification, not what I signed!

     

    Run from this company! Run fast and don't look back! 

    I was forced into doing a Loan Modification! They added close to $25,000.00 to my current mortgage balance; including attorney and late fees. My payments are higher than before!  Their assets are increasing and they are using my tax money to do it.

    I regretfully signed this loan mod! I was given only days to sign it them, without any explanation of the terms or the charges. It was the only thing to prevent the wrongful auction of my home.

    The signed document was recorded with the county. While searching the county records, I noticed that PHH Mortgage servicers changed the name of the bank after I signed it.  Not only did they change the name of the bank, they changed their notary date and added verbiage to the lot description.

    Going back...

    2008; I was faced with foreclosure. The door notice had HSBC's name, to which I have no dealings with.  I pay PHH mortgage services as Merrill Lynch holds my note.  The bank had miscalculated my payments again (that was the 36th time they had done this) which put me in this situation. . An expected commission check was delayed. This caused me to miss my Jan & Feb payment; fortunately, the payment was made March 3. I still owed them for March. They claimed I didn't pay for Dec 2007 (I have proof of my payments). They kept my two payments but didn't post it to my account.

    Their attys, Trott & Trott, told me to bring in a certain amount to them to avoid the auction of my home. That amount included the 2 months I had already paid to PHH servicers. I asked PHH to return my payments so I could pay Trott and Trott. They informed me to subtract the amount and to bring Trott and Trott the balance. I did just that.

    I went to Trott & Trott with certified funds of the balance. They called PHH to verify what I was directed to do. The attorney told me that they were going to refuse my check, to go home & wait for PHH to return the two payments. Once I have all the money together, come back in to pay them.

    It terrified me to hear that, thinking they are going to proceed with the auction. I asked for a letter or note, stating my presence. She refused to give me any type of document stating so. I warned them that I was going to call 911 because I wasn't leaving without one. I actually had to call 911 before they wrote one out for me.

    ok,  my bank refused my Jan and Feb payments, and Trott and Trott refused to accept my payment in full!

    THERE IS SOMETHING WRONG WITH THAT PICTURE!

    I contacted the State of Michigan for help back in June 2008 & to report this company. They miscalculated my payments and I want to know where that money went. They refuse to tell me who actually owns my note. They claim that they do not have to tell me.

    After waiting a year and a half, nothing was resolved

    I recently contacted State of Michigan again for help regards to the recording of false and fraud documents within the county records. I am currently waiting to hear back from them regards to their investigation.

    I contacted Michigan's Attorney Generals Office, St Clair County Prosecutor, Michigan State Police and neither one of them know what to do. Obviously, mortgage fraud is targeted at the consumers and not the financial entities. These are goverment officials, who should know how to handle this!

    This bank & servicer has been caught in the act!

    How much of this is going on?

    So, If you know anyone who has signed a Loan Modification or has foreclosed on their home, ask them to go into the county records (most can be accessed online) to be sure everything is correct and is the same as when they signed.

    Foreclosed homes may show that another bank owned (not the bank the homeowner was making payments to)  the note before the auction occurred.

    I am sure; I am not the only one this has happened to. If you notice anything illegal, please call the FBI.
