    Muskogee County DA, Larry Moore, Gets caught spying in the Courtroom

     

    Muskogee County citizens and attorneys are up in arms about Larry Moore, Muskogee County District Attorney and his office secretly spying in the courtrooms of the local courthouse. The DA was given two laptops by Charles Pearson, Sheriff, which enabled them to view live feeds from the new audio/video surveillance system installed within the courtrooms and hallways. This enabled the DA, his secretary and all members of his office to listen in to privileged communications between defendants and their attorneys, closed courtroom proceedings involving minors, and other confidential testimony. They were caught when it was discovered by a local defense attorney that they were requesting dvd copies of cases from a member of the Sheriff's office who had access to the recorded archives, something which they couldn't do from their laptops.
    The local press has only run one story in the Muskogee Pheonix and the only updates we are getting as citizens is from a side stream media outlet called muskogeenow.com We need help protecting our civil right to have confidential and privileged communications with our attorneys without BIG BROTHER listening in. It is a fundamental right of all citizens but most importantly we have a right against self incrimination! The Sheriff is also releasing jailhouse video of attorney-client privileged discussions to the DA and he is using those against defendants. As citizens, we MUST protect our Bill of Rights but most importantly, we must preserve the integrity of the criminal justice system by stopping this surveillance and infringement.
    As the Supreme Court of the United States determined in Upjohn vs US "If the purpose of the attorney-client privilege is to be served, the attorney and the client must be able to predict with some degree of certainty whether particular discussions will be protected. AN UNCERTAIN PRIVILEGE....IS LITTLE BETTER THAN NO PRIVILEGE AT ALL."
