    Should affirmative action still exist?

    More from JoelBunker

Only for the "special person," whom asked that question?

Are you kidding me? No affirmative action should not exist. For one, it would punish younger generations, like myself, who never owned a slave or oppressed any one. Secondly, why should some one get to go first based on race or sex. Look, if you're smarter then me, a better student, or "special" like the person whom cited an Executive Order for affirmative action!

It was a slow progression, they actually used the Inter-State Commerce Clause to desegregate, and the 14th Amendment. Moreover, affirmative action has been ruled unConstitutional, and could be a cause for a Civil Rights cause of action or 1983 Tort if it is a Government action.

There is the suspect class, where the Courts recognize a certain amount of "suspect class" analysis. Suspect class, means (recognize that certain races had it worse in the past.). However, with every year, and every generation the idea of affirmative action becomes more and more riddiculous and unfair to whites.
