A very brief and quick summary-My husband had a crushed leg injury back in 1985 that was reconstructed and he did awesome on it-in 1993 he was the only survivor in MS from the vibrio vulnificus infection and the leg was the only thing that saved his life. On Dec 23 2001 He went to the dr.s office, culture revealed Type A (not the MRSA) staph treatable with antibiotics-Jan 2 2002, Infectious Diease doctor who was going to lance an edematous in order to provide correct treatment was dismissed by Orthopedic Surgeon who said the "3 phase bone scan" revealed "Chronic Osteomylitis" and said "Patient Obviously is Uncurable" He then Amputated the Left Leg Below the knee and the PATHOLOGIST report stated "NO ACUTE (not even in the simplest form) CHRONIC OSTEOMYLITIS INDENTIFIED_1 organism type A staph Treatable with antibiotics listed below" when the Doctor was confronted about the Pathologist report coming back as stated above...He informed my Husband that "THE LEG WAS GONE, GET FITTED WITH A PROSTHESIS AND LIFE GOES ON- BY THE WAY I AM RETIRING AND RELOCATING TO POPULAR BLUFF MO".. sorry for the caps but these qoutes are exactly what we were told and I have the Documents to Prove it. We got Attorneys (4) that were sooo excited about the case...took it with no questions asked then when it came to the Medical Expert Witness part...They Ran Like scared puppies. One withdrew before she could be disbarred by other clients filing bar complaints against her. One could was going to take it but was handling cases regarding the chicken spill after katrina-which put us in a position to have to enter pro se' an attorney from louisana whom had co-consuled with the first attorney and knew our case couldn't take it because he wasn't licensed in Ms so he found us another MS attorney and entered into the case pro hac vice as second chair. this attorney did the deposistions got to the medical expert witness part..Closed his office down cut his phones off, went to the military in Virgina, and left our case in a storage building in Louisana..I had to get his wife who owns an art museum to go to the storage and get my case back to me and we have never heard from the attorney since-the kicker here is we did not even recieve so much as a phone call from him to inform us of his plans to close down- when we did reach him he said he had finicial difficulites and went back to the military. The Lousiana attorney said there was nothing he could do even though he was co consul and was on paper as being the joint attorney. Now we have a case that has had 4 attorneys digging in it- and all the attorneys we call now say that it's really not worth messing with-and here i was thinking that attorneys had a certain obligation to their clients- i do not feel as any of them have done there best to represent their client (us) to the best of their ability._honestly i feel as though they abandonded the case when it required the most difficult task of finding a Medical expert witness in the same field-which is ridiculous in my opinion, it basically says that the Doctors can act the same as law enforcement officals with a code of silience unless you find a Doctor in the same field to stand up in court and point a finger at the doctor and say you did wrong then --Sorry we cut off your leg from being a little hastey and not doing the proper testing...but there's nothing you can do about it. A 3 phase bone scan was not the proper test to make such a decision according to other physicians. Not to mention if they would have bothered to look in his chart there was already a culture done prior to this that stated it was a type a staph, NOT chronic osteomylitis but instead they did no needle aspriations, no bone biopsy no hyperbaric oxygen treatments...Nothing but a 3 phase bone scan to a leg that had been reconstructed- the vibrio infection causes death within 36 hours and he was the ONLY survivor due to his leg being reconstructed the vibrio attacks your weakest area and can kill you within 36 hours yet they did not see fit to cut his leg off for that. Yet this doctor saw fit to cut it off for a type a staph-a treatable staph, he labeled my husbad as "PATIENT IS OBVIOUSLY INCURABLE" ----That's in Black & white---On Paper!!! I have all the facts on paper in regards to this-This is the gods honest truth--this is no something that is just dreamed up because a patient a little upset because he lost his leg, or his lawyers led him on for years, than ran scared..This is Real life--we had a 9 year old son at the time and this cheated him as well as his dad had just discovered that he did not get his leg cut off for a chronic boneinfection as he was told- it was for a staph infection -treatable- this was not the typical holes in your skin and open lesions type staph his leg was just swollen, and he already had a culture done so it should of never went to a chronic osteomylitis diagnosis especially if the proper test or recommended test were never done. So this is Real Life- and I have debated a thousand times over is there any attorney out there that could at least get this to court and let a jury decide if the standard of care in their opinion was met...Or MAYBE I SHOULD JUST WRITE A BOOK-put all the documents and facts that i have in it-MAYBE IT WOULD BE A BEST SELLER-and my husband would get some Justice and relief of knowing that maybe his story would save someone else from loosing a limb.- Let me leave you with some FOOD FOR THOUGHT-K--when i called about the pathologist report because i couldn't understand how the doctor came up with such a diagnosis so quickly with just a 3 phase bone scan The Pathologist asked me which report did i want...I told him evidently we had the wrong person, he told me no ma'am this is correct because i HAVE TWO PATHOLOGY REPORTS- ONE AT THE TIME OF AMPUTATION WHICH STATES NO ACUTE OSTEOMYLITIS-AND A BONE REVISION THE DOCTOR ALSO DID 7 MOS LATER THAT STATES NO ACUTE OSTEOMYLITIS-"MA'AM I AM THE PATHOLOGIST THAT EXAMINED THIS AND YOUR HUSBAND DID NOT HAVE ANY OSTEOMYLITIS AT ALL...To this date my husband has had type a staph 4 different times in the same leg that this doctor amputated and been treated with antibiotics to clear it up. No one has cut off his knee or above his knee for it..! SO I ASK YOU...if he was incurable and he amputated the leg you would think that took care of the problem right...WRONG..remember he amputated it for chronic osteomylitis..that was never there. only type a staph, and he has been treated on 4 different occasions for type a staph in the knee area of the amputated leg, yet they haven't suggested cutting of his knee. He was a prosthesis, and life has went on i suppose, but i ask you WHERE'S THE JUSTICE IN THESE ACTIONS. is there any...will there ever be any? I am doubtful. "I ASK MYSELF EVERYDAY- I WONDER IF THE SITUATION WERE REVERSED, WOULD THE DOCTOR BE SATISFIED WITH THIS IF HE WAS THE AMPUTEE...i think not!!!. and honestly i feel as though if we were celeberitys or wealthy or a different caliber of people prehaps, I personally feel this may have had a totally different outcome. I could be wrong--but I don't feel that I am._so i ask you "IS THERE ANY JUSTICE FOR SUCH A SITUATION AS THIS?" If so please contact me. To loose a limb in war or combat is one thing to loose one over misdiagnosis and something treatable is yet another. My heart goes out to every single soul that has a lost limb.- i would have attached graphic pictures but i don't think you would want me to put them here.
