    Discrimination

    STEREOTYPES

Stereotypes are often used to hide the cause of homelessness, rampages, and rage shootings. They can also be used against people and to justify different actions or different types of segregation, science is not the place for women, Arabs are terrorists, Italians are in the mafia, mentally ill people cannot manage their own affairs or defense in court for example. Black people sit at the back of the bus and women sit at the back of the bus are more visible forms of segregation. The following posts illustrate the issue and so do the videos at the stereotype section further below.

Stereotypes and Discrimination, the Cause of Rage Shootings a "deranged person" or "mental illness" - (news flash)
Rage Shooting Factors : "The cause of another rage shooting has been said to be "a deranged person" or "mental illness" again. Why does the news not say that the cause of the rage shooting was "an enraged person", people might ask "why was he enraged?"?". It seems to be often used as an explanation when it really isn't one.

The Montreal Charbonneau Commission and Stereotypes - (news flash)
"I believe that the Commission should mention that different stereotypes can be used towards people. Many in the Italian and Arab communities would agree that they are not part of the mafia or terrorists, this applies to members of the construction industry. Mental illness is another stereotype that I am very aware of that can be used and abused for purposes other than what is claimed by different court systems or commissions."

Did Someone Else Write Marc Lepine's Suicide Note and Use a Stereotype, An Arab Father? - CNN iReport (article link)
The stereotype issue, did Mark Lepine commit this terrible crime to "hit back at society" and a suicide note written to hide the cause, mobbing, the mob using homelessness as a weapon, by using a stereotype based on an Arab father.

Repression and the Marc Lepine Stereotype Theory - (news flash)
The mob is repressing targeted citizens through different strategies, pushing targeted citizen to homelessness, smear campaigns, inflicting serious illness and cancer, and by pushing people to violence. Any resulting violence is used to repress and incarcerate them, rage shootings are used to advocate a defenseless population. The Marc Lepine terrible crime stands out, the cause was explained to women, since many were killed, through a stereotype, an Arab father. Stereotype, Arabs abuse and repress women. -- The media focused on an Arab father, sociologists focused on homelessness. -- Pushing people to violence consist of inflicting a damage, financial loss, homelessness, smear campaign and criminal record, serious illness and cancer, and using provocation through a criminal harassment network. see the Damage, Provocation, Rampage video for an illustration on the Rage Shooting Factors page.

    DISCRIMINATION HEALTH RELATED ISSUES

Study shows how discrimination hurts: lack of fair treatment leads to obesity issues - EurekAlert! (article link)

WEST LAFAYETTE, Ind. - People, especially men, who feel any kind of discrimination, are likely to see their waistlines expand, according to research from Purdue University. -- "This study found that males who persistently experienced high levels of discrimination during a nine-year period were more likely to see their waist circumference increase by an inch compared to those who did not report discrimination," said Haslyn E.R. Hunte, an assistant professor of health and kinesiology. "Females who reported similar experiences also saw their waistlines grow by more than half an inch. This shows how discrimination hurts people physically, and it's a reminder how people's unfair treatment of others can be very powerful.

The discrimination that obese people feel, whether it is poor service at a restaurant or being treated differently in the workplace, may have a direct impact on their physical health, according to new research from Purdue University.
"Obesity is a physiological issue, but when people have negative interactions in their social world - including a sense of being discriminated against - it can make matters worse and contribute to a person's declining physical health,"
"It seems that many people are internalizing the prejudice and stigma they feel, and it contributes to stress, which ultimately affects their health."

Researchers from UCLA and the State University of New York-Stony Brook found that out-of-work Americans face discrimination that is unrelated to their skills sets or to the conditions of departure from their previous jobs.
"We were surprised to find that, all things being equal, unemployed applicants were viewed as less competent, warm and hireable than employed individuals,"
"We were also surprised to see how little the terms of departure mattered. Job candidates who said they voluntarily left a position faced the same stigma as job candidates who said they had been laid off or terminated."

    SEGREGATION

    Émilie du Châtelet

    E ∝ mv² -> E = mc²

The physics formula of Emilie du Chatelet is  basically the same as the formula for which Einstein is famous for a  hundred years later, E = mc². Einstein simply replaced the speed of an  object, v, with the speed of light, c, an object. The issue, "science is not the place for a women", was discrimination involved? From what I understand, Émilie du Châtelet out did Newton's, Voltaire, and others beliefs and theories on physics and the formula for which Einstein is famous for is basically the same one that she wrote a hundred year's earlier. She experienced personal tragedies and was recognized ten years after her death. The Discrimination is linked to men and culture "science is not the place for a women" during these periods of time in history.

Acid Violence and Discrimination Against Women in Bangladesh

In Bangladesh women and the beauty of a women is an asset, "ownership, property, possession" of women is linked to discrimination, and the destruction of that beauty destroys the asset. "The patriarchal mindset is the reason for acid violence, especially the beauty aspect. If I take this beauty away from a girl, then no one will marry her. So if this girl is not mine, she will not be anyone else's. For land dispute, also, they want to destroy the asset of the family and therefore they destroy the beauty of the girl."

DEPARTMENT OF JUSTICE AND MARRIAGE ACT

[discrimination] Justice Department will no longer defend DOMA in legal challenges, unconstitutional - CNN (article link)
Washington (CNN)– President Barack Obama has ordered the Justice Department to stop defending the constitutionality of the Defense of Marriage Act, which defines marriage as only between a man and woman, according to a statement Wednesday from Attorney General Eric Holder. -- "The president has concluded that given a number of factors, including a documented history of discrimination, classifications based on sexual orientation should be subject to a more heightened standard of scrutiny," Holder said.
The key provisions in the law "fails to meet that standard and is therefore unconstitutional." -- "Given that conclusion, the president has instructed the (Justice Department) not to defend the statute" in two pending cases in New York state, Holder said. "I fully concur with the president's determination."

Chic-fil-A, The Freedom of Expression is Between a Man and a Women Only? - (news flash)

Is the issue of discrimination, equality, and gay rights getting confused with the freedom of expression? Black people were "different", which justified slavery, segregation, etc., women were the "inferior gender", no education, science is not the place for women, segregation, no vote, etc., and just as their rights to equality were a culture shock the gay community has a right to equality too.

This is what a criminal harassment network and organized crime did to me, a form of assassination attempt through influence of the mind.

I was the victim of workplace psychological harassment, depressed, burnout, followed by a criminal harassment network "you have no future, your future is in the garbage, you are eating garbage, kill yourself, hang yourself, the homeless are in the anus, you are in the anus", I felt purposeless, very negative thoughts about the future from this influence, I was led to believe I caused the death of someone when a minor, the brother's voice of this person was used to "bring me down" further, hate, the criminal harassment network influenced my perception and lead me to believe everyone wanted me to die, "I couldn't escape the hate", repetitive suggestion that I should hang myself, sound technology and repetitive suggestion that I should hang myself, psychological manipulation through sound technology and steps that lead to suicide, "make a plan", "call Denis", a last step before the act of suicide, steps and motion towards suicide, and a hanging attempt.

DISCRIMINATION, WOMEN'S RIGHTS AND THE UNITED STATES

Many people see discrimination linked to religion in foreign countries and don't expect it in the United States. The issue is about limiting health care to women based on different views or religion, discrimination.

This was an issue during the U.S. health care reform debates and again during the 2012 elections.

    STEREOTYPES AND RHETORIC

The pattern is hiding the cause of rage shootings, why?

"a deranged person" "too many guns" these are rhetoric to advocate gun control but not the cause or explanations for rage shootings. This actually reenforces a stereotype against people with mental illness that is already abused intentionally by organized crime.

Example: Non-criminal responsibility before trial in CDN CC 672.12 (1)(3) violates Right to Trial when successful, a human rights violation, which means you are found guilty without a trial, charter violations such as entering your home without a warrant, seizing private computers without a warrant, are all dismissed automatically and the "unlawful" seizure is now legal too. This is linked with psychiatric intervention attempts by the police who need to escape false allegations and charter violations, and the mob, organized crime, using parents to help in psychiatric intervention, which is linked to what is mentioned in the video, parents access to personal medical records.

"we urge the media and professionals who participate in speculative  interviews about the motives of the accused shooter to refrain from  misleading comments about autism and other neurodevelopmental  disabilities. ... (M)isinformation could easily trigger increased  prejudice and misunderstanding."

DISCRIMINATION, MENTAL ILLNESS AND THE RIGHT TO A TRIAL

    Non-Criminal Responsibility Before trial (discriminatory)

    R. v. Swain, [1991] 1 SCR 933, Supreme Court of Canada
    http://www.canlii.org/en/ca/scc/doc/1991/1991canlii104/1991canlii104.html
"I believe, moreover, that conferring on the prosecution a  conditional right to  raise the issue of insanity during the course of  the trial infringes  upon the equality rights of the mentally disabled  under s. 15 of the  Charter. It denies the mentally disabled, a group in  our society which has been negatively stereotyped and historically  disadvantaged, the control over their defences reposed in other accused  persons and does so in a way which is discriminatory.  In denying the  mentally disabled personal autonomy in decision‑making  it reinforces the  stereotype that they are incapable of rational  thought and the ability  to look after their own interests. In a word,  it denies them equality  with other accused persons under the guise,  putting it at its best, of a  benign paternalism. -- It seems to me that  the principle advanced in  support of the prosecution's right to  introduce evidence of insanity can  be effectively implemented by having  the issue of the accused's  insanity raised at the conclusion of the  trial in cases where the  defences put forward by the accused have been  rejected and the essential  elements of the offence have been  established by the prosecution beyond  a reasonable doubt. At that point  I think either party should be free  to raise the issue of the  accused's insanity. I realize, of course, that  there is an element of  circularity involved in this approach in that  insanity has a direct  bearing on proof of mens rea. However, I prefer  this approach since it  both respects the accused's right to waive the  defence of insanity and  ensures that any resultant prejudice he suffers  in the finding of guilt  flows from his own decision not to avail himself  of the defence and  not as a consequence of the prosecution's having  raised the issue in  the middle of the trial process.

    R. v. Langlois, 2005 BCCA 162 (CanLII)
    http://canlii.ca/en/bc/bcca/doc/2005/2005bcca162/2005bcca162.html
[23]In  R. v. Swain, 1991 CanLII 104 (SCC), [1991] 1 S.C.R. 933, the Supreme  Court of Canada considered the accused’s rights in the context of the  operation of the insanity defence under the Code prior to the amendments  in 1992 which brought in the NCRMD provisions. One of the issues in  that case was whether the Crown could raise the issue of insanity over  the wishes of the accused. The Court concluded that the common law rule  that allowed the Crown to raise the accused’s mental state before a  verdict had been rendered violated the accused’s rights to have control  over his own defence. In so deciding, the Court confirmed (at p. 972):  Given that the principles of fundamental justice contemplate an  accusatorial and adversarial system of criminal justice which is founded  on respect for the autonomy and dignity of human beings, it seems clear  to me that the principles of fundamental justice must also require than  an accused person have the right to control his or her own defence. --  [24]The Supreme Court’s response to its finding was to vary the common  law rule to allow the Crown to raise the issue of the mental capacity of  the accused only after the court had concluded that the accused is  otherwise guilty of the offence — the procedure adopted in the NCRMD Code provisions in 1992.

    R. v. Wells, 2004 ABCA 371 (CanLII)
    http://canlii.ca/en/ab/abca/doc/2004/2004abca371/2004abca371.html
[8] The following Criminal Code sections are relevant to the defence of NCRMD:
    16.  (1) No person is criminally responsible for an act committed or an  omission made while suffering from a mental disorder that rendered the  person incapable of appreciating the nature and quality of the act or  omission or of knowing that it was wrong.
    (2) Every person is  presumed not to suffer from a mental disorder so as to be exempt from  criminal responsibility by virtue of subsection (1), until the contrary  is proved on the balance of probabilities.
    (3) The burden of proof  that an accused was suffering from a mental disorder so as to be exempt  from criminal responsibility is on the party that raises the issue.
672.12  (1) The court may make an assessment order at any stage of proceedings  against the accused of its own motion, on application of the accused or,  subject to subsections (2) and (3), on application of the prosecutor.
    (2)  Where the prosecutor applies for an assessment in order to determine  whether the accused is unfit to stand trial for an offence that is  prosecuted by way of summary conviction, the court may only order the  assessment if
    (a) the accused raised the issue of fitness; or
    (b) the prosecutor satisfies the court that there are reasonable grounds to doubt that the accused is fit to stand trial.
    (3)  Where the prosecutor applies for an assessment in order to determine  whether the accused was suffering from a mental disorder at the time of  the offence so as to be exempt from criminal responsibility, the court  may only order the assessment if
    (a) the accused puts his or her mental capacity for criminal intent into issue; or
    (b)  the prosecutor satisfies the court that there are reasonable grounds to  doubt that the accused is criminally responsible for the alleged  offence, on account of mental disorder.
672.34 Where the jury, or the  judge or provincial court judge where there is no jury, finds that an  accused committed the act or made the omission that formed the basis of  the offence charged, but was at the time suffering from mental disorder  so as to be exempt from criminal responsibility by virtue of subsection  16(1), the jury or the judge shall render a verdict that the accused  committed the act or made the omission but is not criminally responsible  on account of mental disorder.
[10] The Crown’s ability to raise the  issue of an accused’s mental capacity is governed by the decision of  the Supreme Court of Canada in Swain. Swain confirmed that when an  accused does not want to rely on a s. 16 defence of NCRMD, the Crown may  raise the issue independently. By doing so the Crown helps ensure that  an accused is not wrongly convicted. However, in order to be minimally  intrusive on the accused’s right to control the conduct of his defence,  the Crown must wait to raise the issue until the trier of fact has  decided the accused is guilty of the offence. If the accused is  acquitted, the Crown cannot raise the issue.

    Criminal Code, RSC 1985, c C-46
    Where court may order assessment
672.12 (1) The court may make an assessment order at any stage of proceedings against the accused of its own motion, on application of the accused or, subject to subsections (2) and (3), on application of the prosecutor.
Limitation on prosecutor’s application for assessment of fitness
    (2) Where the prosecutor applies for an assessment in order to determine whether the accused is unfit to stand trial for an offence that is prosecuted by way of summary conviction, the court may only order the assessment if
    (a) the accused raised the issue of fitness; or
    (b) the prosecutor satisfies the court that there are reasonable grounds to doubt that the accused is fit to stand trial.
Limitation on prosecutor’s application for assessment
    (3) Where the prosecutor applies for an assessment in order to determine whether the accused was suffering from a mental disorder at the time of the offence so as to be exempt from criminal responsibility, the court may only order the assessment if
    (a) the accused puts his or her mental capacity for criminal intent into issue; or
    (b) the prosecutor satisfies the court that there are reasonable grounds to doubt that the accused is criminally responsible for the alleged offence, on account of mental disorder.

Groups: Autism not to blame for violence
    http://www.cnn.com/2012/12/17/health/connecticut-shooting-autism

While the motive for this crime is still unknown and may never be fully understood, what is clear, according to experts, is that autism cannot be blamed. -- "There is absolutely no evidence or any reliable research that suggests a linkage between autism and planned violence," the Autism Society said in a statement. "To imply or suggest that some linkage exists is wrong and is harmful to more than 1.5 million law-abiding, nonviolent and wonderful individuals who live with autism each day." -- Peter Bell of Autism Speaks said, "Autism did not cause this horror." Bell, executive vice president for programs and services for the advocacy and research group, is also the father of a son with autism. -- Bell said it's not unusual to want to figure out why someone would commit such a heinous crime, but he also cautioned people to do so responsibly. -- And by definition, he said, people with a diagnosis of autism or Asperger's are not inclined to commit an act of violence. The likelihood of this happening would be no different than the rest of the population, he added. -- Autism spectrum disorders, including Asperger's syndrome, are a range of developmental disorders of the brain. -- They can cause significant social impairments, communication problems and restricted, repetitive and stereotyped patterns of behavior. -- It's important for the public to know that the gunman's actions can't be linked with autism spectrum disorders, said Dr. Max Wiznitzer, a pediatric neurologist and autism expert at Rainbow Babies and Children's Hospital in Cleveland. -- "Aggression and violence in the ASD population is reactive, not preplanned and deliberate," he said. -- In a statement, Autistic Global Initiative Director Valerie Paradiz said, "The autism community has long labored toward building understanding, awareness and trust within communities throughout the United States and the world. -- "As adults with autism living productive, peaceful lives, we urge the media and professionals who participate in speculative interviews about the motives of the accused shooter to refrain from misleading comments about autism and other neurodevelopmental disabilities. ...
