Garnishment of Wages
Yesterday there was an Ireport from an individual bemoaning the fact that 60% of his income was being garnished to pay back taxes he owed. That got me to thinking that 60% was too high. The Ireport is gone so I cannot go back to check it. But I did a little research that shows wage earners can only have 25% of qualified wages above a minimum amount of income garnished. Who can order a garnishment? Generally a judge but also the IRS. The Federal Department of Education agencies can also order the garnishment of up to 10% of qualifying wages without court order. Tips are not included as wages for purposes of garnishment. State laws can also put further restrictions on garnishment
