I am a 52 year old man and I lived with my girlfriend 32 years. My girlfriend died 3/18/2011 just a few weeks from having a living donor liver transplant. Sad thing is what she died from had nothing to do with her liver and was unexpected!. Ever since she died I tried to pay off our home. And contacted Chase the first time on 3/30/2011 to inform them of her passing and to tell them that I would be closing her accounts as needed to by law. That they could'nt do auto pay on the mortgage anymore from her accounts. And that I wanted to payoff the loan. Chase bank would not deal with me because my name was'nt on the loan, and I was told that they would need the papers from the courts showing that I control of the estate. I was to fax those papers to a number they gave me. So on 4/14/2011 I got the papers from the courts in Maine naming me as the personal rep of the estate. I took those papers to the Maine national guard family support and faxed them off. The same day I mailed the same papers to the address that they had also given me. I then called Chase to see if they would give me the payoff. I was told that it would take a few weeks for them to get it in to their computers and they would be in touch. I waited three weeks and heard nothing so I called. I explained who I was and told them that I was getting mail for my girlfriend who had passed away saying the mortage was late and I wanted to pay the house off. They told me I was'nt listed on the loan yet and it would take more time. We are now going into the first few weeks of June and I am now getting letters still addressed to my decesed girlfriend saying that the home was in danger of being foreclosed on with a number to call if you need help. So of course I call that number and explain who I am and that they really need to get their act together and get me the payoff figure. So that I can put this behind me and try to move on with my life. More time, more phone calls to Chase and more nasty letters from Chase to my belated threating forecloser. After I could'nt take calling the number in the letters and being told the same thing anymore I googled Chase and found that as close as they came to Maine was Bridgeport Conn.,a 6 hour drive for me. I call the branch and asked to speak to the branch manger. I then explained who I was and how my girlfriend had passed and told him that I wanted to payoff the house. I explained how I had sent the papers both in a fax and by mail, and that I was'nt getting anywhere. So I give him the account number and offered to drive to His branch with any papers he needed plus a cashiers check for the payoff. He was very nice and wanted to help and told me to give him a few days and he would see what he could do. A few days later I called him back and I was told it had to go thru corparate. He then gave me a Number to the executive office in charge of mortages. I called that number and talked with a executive vice president in that department. Once again I told my story and once again asked for the payoff. And once again I was told to give him some time to look into it. well time went on with more phone calls and more nasty letters still addressed to my dead girlfriend threating forecloser. We are in the middle of August by now and now they have people knocking on the door asking for my girlfriend who I tell them she has passed away. They give me a paper with a number to call so she can stop the forecloser. So of course I call the nimber and once again I am told they cant deal with me because I am not on the loan. I Am also calling the execuitive vice president in the mortage department telling him he needs to get me the payoff and get this straghted out. He is nice and tells me he is having a hard time getting the final payoff because I am not listed on the loan and to give him more time. A few days later a sherriff comes to my door and hands me a forecloser notice made out to me as the personal rep of the estate. I call the executive vice president in charge of mortages and tell him I am floored that this is happening and that it is obvious that someone knows who I am because I was just served forcloser papers made out to me!!! So now I am told not to worry that I am paying off the loan and that its a moot point in the big picture. A few days later the executive vice president calls me back and tells me that he still doent know what the payoff is but that if I send/wire the principal in it will stop the forecloser and then it will just be a matter of me paying off the rest as soon as he knows how much it is. So I do as is asked and wire over $66,000 (the payoff at this time I found out was $71,000 and the home was just appraised at $210.000) to Chase. it so happens this is on the same day as my first court date for the forecloser. A information hearing on forecloser. I go to that hearing and show the judge the wire transfer and explain what is happening he says looks like your all set. 9 days later my bank calls me and says that the wire transfer came back??? So once again I call the vice presidemt in charge of mortages and ask him whats going on! He says that it should'nt have come back and to wire it again, I tell him ok and that I will call him with the comformation numbers as soon as I do, I also tell him I would send the whole payoff if he has that info yet? Of course that was wishful thinking. I then call my bank and have them rewire the money and then call Chase back with the comformation numbers. I wait on the phone while the vice president calls and comfirms that yes they have the money and that yes he flagged it so they would apply it to the loan. 9 days later my bank calls again? and once again the money came back. once again I call chase and ask why??? This time they say they need my girlfriends w-9 form. I ask why they did'nt keep the cash and just ask for the w-9? So of course the cash is rewired again along with the w-9 and still no I have no payoff figure? Ten days later my bank calls and says your wire came back yet again! Really fustrated I call the mortage department and speak to them again and told to send it yet again. The whole time this is going on I am not going to the medition hearings and such because the executive vice president in charge of mortages is telling me not to worry and dont bother because I am paying off the loan and he is stopping the forecloser on his end. the third time the money came back I went and hired a lawyer. we are in the first week of the new year by now and I explain to him that when my girlfriend died we had just gutted the house, no sheetrock insulation a kitchen or anything so when she came home she'd have a bathroom and bedroom downstairs after the transplant. I was told that the house was my investment and that I should finish it off seeing as how Chase was'nt taking my money and winters in Maine without sheetrock or insulation just cant be done. Then I could get a loan if need be to settle with Chase when the time came. I never gave it a thought that even thou I had worked the same job and company for twenty years I would'nt be able to get a loan because i had no credit, But my girlfriend handled all the money and paid all the bills for 32 years, plus i stayed home and didnt work for three years taking care of her as she was slowly dying and your home is in forecloser forget a loan...! We went to court in Sept. and I lost in court because I never sent the full payoff, and because I had the chance to if I had gone to the medition. But of course I didnt because I was told your paying off the loan dont worry bout that stuff I am taking care of it on my end. We are on appeal right now but I dont have the money to pay my lawyer anymore so that will be dismissed on the 25th of this month and I cant get a loan for $80,000 the payoff now with the forecloser cost. So even with a $210,000 dollar home with over 100,000 in equity I am losing my home.
Thank you Chase well played never saw it coming...!
