Skilled immigrant green applications are processed on the basis of your place of birth, not nationality. India and China with more than a billion people send thousand of students to USA for graduate school, including MS and PhD programs at Top notch US schools. But when their employer files for their green card, it takes them not less than 5 years if they have masters degree and sometimes 15 years if they have bachelor degrees. This is because based on your place of birth, a fixed number of green cards are allocated to each country. They don't take into account the size of the country or the number of graduate or post graduate students those countries send. So Maldives is treated same as India. While a master's degree holder from Maldives can get his green card in six months, Indians take at-least 5 years and if they lose the job in that time, they get kicked out of the country or have to start the whole process again through a new employer. Due to this policy, many qualified Indians have left for Canada, Australia and New Zealand, including the famous Software programmer from Google Maps, who moved to Canada. It hurts when their is talk to give a path to citizenship to illegals while legal immigrants waited in Line for years, paid thousands of dollars in tax and got treated like trash. Looks like the best way to be in America is Illegal! Secondly, processing time and visa allocation based on place of birth has to end. More emphasis needs to be given to qualifications.
