This Serious Matter Can or Will Soon Involve Penalties for non-Payment of taxes to a Federal Agency, the IRS and/or the California State Franchise Board, a State Agency.

Dear Senator Feinstein:

On January 19, 2013, I received 2012 form 1099-R from the LADWP which shows in "box 2a" a taxable amount of $30,515.40, and a Federal income tax being withheld in the amount of $922.20. To date, I have yet to receive or make use of a dime of the $30,515.40, and worse yet this document is not based on the truth. On March 12, 2009, after 30 years of employment with the LADWP, I was discharged minus all retirement benefits, which is just as true today as on March 12, 2009. I have yet to affix my signature on any vested retirement document and doing so would be against my best interests. It is an act of fraud for any government agency to knowingly and intentionally make use of the U.S. Postal Service to mail false or fraudulent documents. In filing any tax return, I only pay taxes on income truly received.

I have no intention of filing any tax document to reflect an additional $31, 542.84 in gross income distribution, for a taxable amount of 30, 515.40 to pay taxes to the IRS, a Federal Agency or any state tax amount to the California State Franchise Board. Since the IRS and the California State Franchise Board place penalties on taxpayers for unpaid taxes, this will be contested because I refuse to pay taxes on income not received.

Since August 25, 2010, I have not received a "Water and Power Employees Retirement Plan Retirement Membership System Annual Member Statement" or equivalent financial statement from the Water and Power Employees Retirement Plan Section to show the status of LADWP employee retirement earnings, contributions, etc., etc., which is also a serious infringement on my property rights. I receive quarterly and annual financial statements from every private industry Banking Institution that I have ever had an account with to provide documentation for my financial savings, checking, withdrawals, interest earned, stock market earnings, etc., yet the LADWP retirement section has even failed me here.

" I want to be as helpful as possible. However, the problem you have outlined regarding Los Angeles Department of Water and Power appears to be one that can only be resolved by your local city or county government. I recommend you get in touch with either your Council Member or County Supervisor, and discuss your case with either, or both, of their offices."- Correspondence dated August 19, 2011, a copy of which is enclosed.

Issues left unresolved or blatant atrocities of bad government:

Ø Through formal correspondence and by verbal statements, both my Mom and I, have formally petitioned 10th District LA City Councilman Herb Wesson, 2nd District LA County Supervisor Mark Ridley Thomas, Los Angeles Mayor Antonio Villaraigosa, and other public servants, about me not receiving LADWP retirement benefits.

Ø Longstanding and unresolved, Los Angeles Superior Court Case 895188, where the Defendants the LAUSD have admitted guilt.

Ø Superior Court Case BC385899-The perjured testimony of Los Angeles City Attorney Lisa Berger and CC, Article 6, Section 19 demands that Judge Mark Mooney render a decision, and to date I have yet to receive this.

Ø The Demur to Los Angeles Superior Court Case 10K18049-LA Superior Court Clerk Delores Odom Stocks signed a "default court judgment", when court clerks do not have this authority. Judge Steven Kleifield, the Judge of court of record, being the only qualified court official qualified to render a court decision, and by CC, Article 6, Section 19 demands this be done, and to date I have yet to receive this.

Ø Sacramento Superior Court Case 34 2011-00109374, Judge Shellyanne W. L. Chang, Article 6, Section 19 demands that Judge Shellyanne W. L. Chang render a decision, and to date I have yet to receive this.

Ø Los Angeles Superior Court Criminal Court Case #1CA17487, my good reputation is still good in spite of being convicted and placed on probation in the Kangeroo Court Trial, before Judge Yvette Verastegui

Ø California Appellate Court Case BR 050017 appeal court documents contest and disprove the decision of Judge Yvette Verastegui in Case #1CA17487.

These issues can only be resolved by elected officials who respect the oath of office and other government employees who respect the U.S. Constitution, "The Bill of Rights", the California Constitution, and the rule of law to serve law abiding U.S. born descendants of slavery like me. The very individuals to whom you referenced, in the correspondence dated August 11, 2011, who should have been the first to respond and take action to resolve these issues, are of my same ethnic background, have no respect for the Constitutional rights of people like me, and this is the problem.   2nd District Los Angeles County Supervisor Mark Ridley Thomas, 10th District Los Angeles City Councilman Herb Wesson- effected a "citizen's arrest" to have my Mom, Mrs. Esther M. Lofton arrested and jailed by the LAPD, Deputy Public Defender Sherise Francis-stated to me "forget about the Constitution, keep it simple" the result being an unearned conviction in Criminal Court case 1CA17487, Superior Court Clerk Delores Odom Stocks- signed a court  judgment at my expense, District Attorney Jackie Lacey, California Attorney General Kamala Harris, etc., etc., have been petitioned to resolve these serious issues, yet to date, to no avail.

Once again, I'm faced with having LADWP utility workers disconnecting Electricity and Water service at my residence, for non-payment of LADWP utility bills, all while the LADWP continues to hold all my earned retirement benefits, and while elected officials sworn under oath and mandated by law to uphold the California Constitution fail to be competent and responsible elected representatives. This is "Taxation Without Competent Representation".

I do believe that far too often, U.S. born blacks make the mistake of using the voting process as a popularity contest, as opposed to voting for an elected official based upon the belief or knowledge that the individual voted for will respect the Constitution, the “oath of office”, without respect to political party affiliation, i.e., Democratic, Republican, Tea Party, Conservative, Liberal, or other affiliation if an elected official has contempt for the “oath of office”, the Constitution, the Rule of Law, etc., then he or she must be removed from political office by any means necessary.

The Republican Party also has at least one "sellout" and prominent black official who has been selling out the black community for decades, namely siding with rogue police officers and unethical city prosecutors while betraying law abiding black men or women egregiously violated by government no good U.S. Supreme Court Justice Clarence Thomas.
