    Commentary: NY SAFE Act Protest -- February 28 2013

     

    According to CNY Central, there more than 5000 protesters at the steps of the state capitol of New York protesting the NY Safe Act that was passed very quickly by the New York State legislature.

     

    The controversy surrounding the law is in the provision that makes it illegal to have firearms that can have magazine with more than seven rounds. It makes it a felony to possess these items and thus as a result, makes law abiding American citizens in the State of New York criminals overnight.

     

    The NY Sheriffs Association[1] have weighed in and believe that the definition of an "assault weapon" overtly too broad and would not hinder criminals from using whatever weapons they may have in their arsenal to commit crimes. It will hinder the means in which law abiding American citizens will be able to defend themselves.

     

    If I may, I would like to comment briefly on this issue. As a citizen of the State of New York and resident of Connecticut, this law will not affect the outcome of criminals. Also, Andrew Cuomo believes that no one should possess a weapon that can hold more than 30 rounds for duck or deer hunting. If I may remind the people, including Andrew Cuomo, the 2nd Amendment is not for duck or deer hunting. It was put in place by the Founding Fathers as a mechanism for the people to protect themselves from the government. That whenever the government became tyrannical, the people had a way to resist, defend and protect, their State, their country, families and property.

     

    Some may argue, how can simple people resist the U.S. military if it ever tried anything illegal under the color of authority? May I remind the readership at large, that it was simple farmers that defeated the most powerful military the world had ever seen, the British, in the "shot hear 'round the world.' Also, it was the simple farmer in Viet Nam that withstood the might of the U.S. military from 1964 to 1973. It is not to suggest or to say that this is a call for rebellion to overthrow our republic, but to demand our leadership, our elected representatives, to uphold their oath to support and defend the Constitution, word for word.

     

    I am firm believer in our Constitution, it is the only document, besides the Declaration of Independence, as than British Prime Minister put it, "as the British Constitution is the most subtile organism which has  proceeded from the womb and the long gestation of progressive history,  so the American Constitution is, so far as I can see, the most wonderful  work ever struck off by the brain and purpose of man." This is undoubtedly true, and yet, we have own elected officials, like governor Cuomo, who are subverting the U.S. Constitution, he swore to upload, in the name of public safety, when in reality the only safety the NY SAFE Act safe guards is the State's and not the people.

     

    Any one who is under the illusion that the 2nd Amendment is for duck hunting is has not read our history or understand the spark that started the American Revolutionary War, our War for Independence. Would you like to take a guess? Gun confiscation! One can make the case that it can never happen here on American soil. The problem is that it has. Just ask the gun owners during Hurricane Katrina.
